THE UNDERSIGNED GENERAL DIRECTOR OF THE OFFICE OF MARINE MERCHANTS in exercise of the powers granted by the law
That by means of petition submitted to this General Office on September 26, 2017, the Forensic Firm PATTON, MORENO & ASVAT, acting as Legal Representative of the Company MOKRAN EIMENE PARSA CO., a company duly formed under the laws of Iran, with Registration No. 436247 and with domicile located at No 303, Shahid Behesti St., Teheran, Iran, has requested to this General Office authorization for the company MOKRAN EIMENE PARSA CO., as Security Private Company recognized and authorized by the Maritime Authority of Panama to provide the use of security armed or disarmed staff, on board of the Panamanian flag vessels as Security Private Entity to assure compliance of the minimum requirements set out by the International Maritime Organization in memos MSC.1/Memo 1405/Rev.2 and MSC.1/Memo 1406/REv.2, both dated May 25, 2012 and based on the provisions of Resolution No 106-13-DGMM dated March 8, 2012, amended by Resolution No 106-85-DGMM dated December 17, 2014.
That the Forensic Firm PATTON, MORENO & ASVAT, has attached to their petition a duly authenticated Power of Attorney, Certification of the Company formation in its country of origin and the documents requested as per Resolution No 106-13-DGMM dated March 8, 2012, amended by Resolution no 106-85-DGMM dated December 17, 2014.
That the Department of Resolutions and Enquiries of the General Office, sent the petition of the Company MOKRAN EIMENE PARSA CO., to the Department of Maritime Protection of Vessels of this General Office, which by means of Petition no 105-02-085-DGMM-DPMB dated October 17, 2017, issued its Technical Criterion to be assessed by the Committee of Technical Evaluation.
That such Petition sates that the name MOKRAN EIMENE PARSA appears in the Quality Management Certificate ISO and the Company Registration Certificate indicates that the name is MOKRAN EIMENE PARSA CO.
That in order to assure the effectiveness and capacity of the Panamanian Maritime Authority in the process control of recognition and certification performed by companies different from the "Recognized Organizations", the Committee of Technical Evaluation by means of Resolution No 106-14-DGMM dated March 18, 2008, with the purpose of establishing procedures which, at the discretion of this Maritime Administration, will verify the effectiveness with which they will execute the power to be delegated, since the quality of such services will be directly related to the maritime security.
That according to section 4, number 2 of the Resolution No 106-14-DGMM dated March 18, 2008, among the functions of the Committee of Technical Evaluation is the recommendation made to the General Director of the approval or rejection of equipment, devices, additions, materials and components, which will be used as alternate means for compliance of the provisions set forth in different International Agreements ratified by Panama, related to the security, protection and contamination rules of the Panamanian Flag vessels in the national territory.
That according to Section 4, number 3 of the above-mentioned Resolution, among the functions of the Committee of Technical Evaluation is also the recommendation to the General Office of Merchants, the approval or rejection of companies which require the provision of a specific service on board of Panamanian Flag Vessels or any vessel which is in the national territory.
That according to section 4, number 5 of the above-mentioned Resolution, the Committee of Technical Evaluation will, among its functions, recommend rules, requirements and internal and external technical procedures for different petitions.
That section 6 of the above-mentioned Resolution sets forth that: "once evaluated the submitted documentation, the committee will recommend the General Director of Marine Merchants by means of a record the approval or not of the petition and the General Office will issue a Resolution in which the petition is recognized or rejected."
That by means of Resolution No 106-13-DGMM dated March 8, 2012, the General Office of Marine Merchants issued some regulations to govern the security private companies, to provide a service of voluntary use of armed staff on beard of Panamanian flag vessels, which navigate exclusively in areas of high risk of pirate attacks and armed robberies.
That section 2 of the Resolution No 106-13-DGMM dated March 8, 2012 sets forth that: "ESTABLISH" a system for using security private companies in Panamanian Flag Vessels, with the purpose of assuring compliance with the minimum requirements established by the International Maritime Organization, in MSC.1/Memo 1405/Rev.1 date September 16, 2011."
That by means of Record 5/2017 dated November 1, 2017, the Committee of Technical Evaluation recommends to the General Director of Marine Merchants the approval for six (6) months of the petition submitted by MOKRAN EIMENE PARSA CO., as security private company, to provide the voluntary service of armed staff on board of the Panamanian Flag vessels, which navigate exclusively in areas of high risk of pirate attacks and armed robberies, until the name of the company MOKRAN EIMENE PARSA CO., is amended in the Certificate of Quality Management System ISO.
IT IS HEREBY RESOLVED:
FIRST: TO APPROVE provisionally for six (6) months, the petition submitted by the company MOKRAN EIMENE PARSA CO., a company duly formed under the laws of Iran, with Registration No. 436247 and with domicile located at No 303, Shahid Behesti St., Teheran, Iran, to provide the service of Security Private Company recognized and duly authorized by the Maritime Authority of Panama to provide the use of armed or disarmed security staff on board of Panamanian Flag Vessels as Security Private Entity to assure compliance of the minimum requirements set forth by International Maritime Organization in memos MSC.1/Memo 1405/Rev.2 and MSC.1/Memo 1406/REv.2, both dated May 25, 2012 and based on the provisions of Resolution No 106-13-DGMM dated March 8, 2012, amended by Resolution No 106-85-DGMM dated December 17, 2014, until the name of the company MOKRAN EIMENE PARSA CO., is amended in the Certificate of Quality Management System ISO.
SECOND: Inform the company MOKRAN EIMENE PARSA CO., that this Administration may establish control and follow-up procedures to determine the effectiveness of the service rendered.
THIRD: Inform the company MOKRAN EIMENE PARSA CO., that its service will conform to any new regulation issued by the International Maritime Organization of Panama. Thus, the company will be governed by the new standards, once the regulations come into force.
FOURTH: The approvals of the Security Private Companies may be revoked, suspended or cancelled by the Office of Marine Merchant by means of justified resolution in case there is non-compliance of the rules contained in this Resolution or by infringing any currently in force rule or international agreements ratified by the Republic of Panama, as well as any guideline issued by the General Office of Marine Merchants.
FIFTH: Inform that in case of claims submitted by deficiencies in the service provided, the company MOKRAN EIMENE PARSA CO., will be the only and exclusive responsible party for these claims.
SIXTH: Inform the interested parties that an appeal for reconsideration may be filed against before this Office within the five (5) business days subsequent to the notice thereof.
